Controller John Chiang to Governor: I Won't Follow Order to Cut State Worker Pay


This is the complete letter sent to Governor Schwarzenegger by California State Controller John Chiang following the Governor’s signing of an Executive Order that among other things ordered the pay of over 200,000 California state workers to be cut to the federal minimum wage during the state budget impasse. Chiang not only challenges the legal authority of the Governor to make this order, but he also challenges the purported factual need for it and other assertions made by the Governor and warns of potential additional liabilities this action could cause the state to incur.

Dear Governor Schwarzenegger,

I understand that today you signed an executive order (Order) demanding the salaries of more than 200,000 civil servants who are covered by the federal Fair Labor Standards Act (FLSA) be cut to the federal minimum wage of $6.55 an hour.
