The State Senate failed to approve a budget, which contained the Governor's compromise plan as revised by Senate Democrats, but could not win any Senate Republican votes that are needed for passage. The vote was strictly on a party line vote of 24 votes in favor and 15 against. California is now 60 days without a State budget. A summary of the Governor's compromise plan as revised by the Senate Democrats is available on the CDCAN website at www.cdcan.us
The Senate recessed for about 45 minutes and will take up action on bills.
The compromise plan is in AB 1781 by Assemblymember John Laird (Democrat - Santa Cruz) which contains the main budget bill and AB 88, as amended on the Senate floor today, that contains revisions to AB 1781. That bill also failed to pass also 24-15.
No budget related bills called "trailer bills" that contain policy changes or changes to State law, were presented or brought up for a vote.
"I have never heard about negotiating but not talk about certain things," said Senate President Pro Tem Don Perata (Democrat - Oakland) , showing some anger, and challenged Senate Republicans to come up with their detailed budget plan. that doesn't borrow, have cuts and doesn't raise taxes.
"Give us alittle something to tell the parent of a autistic child...that we are going to make it okay for them in California...," Perata told Senate Republicans.
Sen. Sam Aanestad (Republican - Grass Valley) said they had in previous budget years presented their budget plan but it got shelved and wanted assurances from Perata that it would be heard.
State Constitution Requires Super Majority Votes To Approve Budget
The State Constitution requires 27 votes to approve a budget in the State Senate. Democrats control 25 of the 40 State Senate seats, with Republicans holding the remaining 15, which means if every Democrat votes for the budget plan, at least 2 Republicans are needed to vote for it too. In the Assembly, 54 votes are needed to approve a budget. Democrats hold 48 of the 80 seats, with Republicans controlling 32.
Perata Said Democrats Are "Done"
Senate President Pro Tem Don Perata (Democrat - Oakland) said Democrats had enough of negotiating with the Governor and Legislative Republicans saying that "Gentlemen, we are done...we have had it with reaching an agreement with the Administration and then be told to give more."
Sen. Denise Ducheny (Democrat - San Diego) said that "Combined with the second bill, really holds the line. It is a baseline budget, preserves baseline funding for schools...healthcare...social services. Nobody gets a COLA (cost of living)...it does not expand programs at any level.”
No other Senate Democrats spoke on the budget plan.
Senate Republicans as expected, refused to support the budget plan, which includes a temporary three year 1 cent increase of the State sales tax, saying more spending cuts and reforms were needed and opposed any tax increases that they claim will hurt California during bad economic times. Republican Senators Bob Dutton, Jeff Denham and George Runner, Tom McClintock, Roy Ashburn and Dave Cogdill, the Senate Republican Leader, all rose to speak in opposition to the budget compromise. Senate Republicans said they opposed major policy changes in the plan including changes to sentencing of persons in California prisons, proposals to raise the sales tax, even if temporary, and that without spending caps and reforms, that the budget deficit will grow even larger next year.
Sen. Roy Ashburn - who the Governor and Democrats had hoped would be one of the 2 Senate Republicans who would support a budget compromise plan, spoke out against the plan that he said did not include real budget reforms.
Budget Delay Having Major Impact on Community Organizations Serving People With Disabilities, Seniors and Others
California has been without a budget for 59 days, with the impact of the budget delay growing for community organizations and others who provide critical services and supports for thousands of children and adults with disabilities, mental health needs, seniors and others. Advocates remain deeply concerned about the impact of the delay - but also concern about additional spending cuts to critical health and human service programs.
Assembly Voted On Budget August 17
The Assembly did not vote on a budget plan today. The Assembly last voted on the State budget - a Democratic budget plan (as passed by the Budget Conference Committee in June) on August 17, Sunday evening, that fell 9 votes short of passage. There has not been another vote in the Assembly since then.
CDCAN SUMMARY OF PLAN
Budget Reform
* Senate Democrats appeared to have made a major concession by agreeing to give the Governor - and future governors - the authority to make spending cuts by 7% during a budget year, in times when the State budget is in a deficit, though specifics are not available. This new authority is something the Governor has proposed in August and in his budget reform proposals that he made in January, and also in previous years. Previously Democrats in both houses have rejected those proposals
* Agreement to the Governor's proposal for a "rainy day" fund.
CDCAN Comment: the spending cut authority has been also previously opposed by advocates - though there are no details yet available on how the authority would work - and the authority would be limited to 7%. Senate Republicans say the spending cut authority as revised by Senate Democrats, is undermined by approval that is needed in the Legislature.
SPENDING CUTS
* Most of the additional spending cuts in the Governor's August compromise are agreed by the Senate Democrats in their revised plan - but rejects the Governor's proposal to cut (suspend) the federal cost of living money due January 1, 2009 for people receiving SSI/SSP.
CDCAN Comment: Total spending cuts in the budget compromise plan includes over $9 billion. Those cuts include, as approved and contained in the spending plan as adopted by the Budget Conference Committee controlled by the Democrats, would remain in the budget, including cut to the State cost of living for SSI/SSP due June 1, 2009 through May 31, 2010. However that budget plan also restored most of the Medi-Cal provider rate reductions - and the compromise plan that will be voted on Friday maintains that restoration. Other cuts, including the permanent cuts to regional centers (called "cost containment" measures) and the cut to the State cost of living for SSI/SSP due June 1, 2008 through October 1, 2008, that the Legislature approved in February, remain. The cut to Medi-Cal providers, also approved in February and effective July 1, 2008, has been blocked by a temporary federal court order.
TAX INCREASES
* Agrees for a temporary three year sales tax increase of 1 cent, as proposed by the Governor, but rejects the other parts of the Governor's proposal that would lower that tax after three years.
CDCAN Comment: The change in the Governor's plan, which would have reduced the overall sales tax after three years, may lose the possible vote of Republican Sen. Roy Ashburn who said earlier that he could possibly support a sales tax increase if it resulted in a reduction - as the Governor's plan did. The Senate Democratic revised plan eliminates the reduction and only proposes a 3 year temporary increase - a proposal that Republicans in both houses have strongly opposed.

I am certain that all of you know the obvious impact this has on people with developmental disabilities and our seniors. It is time to come to some kind of agreement that will at least allow the most needed the quality of life they so richly deserve. Decide and pass the budget

It figures! Us poor working folks can see no light at the end of the tunnel. This is how our State Leaders take care of us. Our State is facing a very serious crisis, one that has already begun. Now what? Tell me who is going to pay my car payments, my daughters health insurance, my rent and our daycare provider?? Thank you "Oh Great State Leaders" for caring so much about the people that put you in office..

I work for one of the companies that is being affected dramatically by this budget not being signed. I pray daily for a resolve to this whole budget mess, and a day when we don't have to plan for no income because elected officials are on vacation, or have their own agendas, and meanwhile hold our children hostage to their negotiations. They should be sitting there in the office 24/7 until this is resolved!!
Not taking half days not taking weekends until there is a solution!!! No matter if they are republicans or democrat's sit there until something is done!!!!
You know what... doesn't matter if they raise taxes because before they agree on anything and sign the budget our businesses won't be leaving we will be closing down. Now California won't be getting any of our taxes. This is something that should have been settled 60 days ago. Fire all of them!!

So, I guess we are going to break the record: the most abysmal budget season in California history!!! I have not been paid since July 1st. I have maxed out all available credit, borrowed from relatives and cut back on expenses all throughout the summer. Meanwhile I have more than enough invoices approved and waiting to be paid in Sacramento. Do I get to tell my health care providers, insurance carriers, landlord, etc. that I can't balance my budget??? I'm so fed up with the stubborn minority I don't know what else to do. Meanwhile, I have to keep providing services and fronting hundreds of dollars of costs that are not being reiumbursed by the state. Seriously, what do the rich Republican minority expect us to do??? I'd rather pay an extra 1% sales tax. At least I would have something with which to pay it.

MAYBE THE FIFTEEN REPUBLICANS WHO VOTED NO SHOULD TOUR THE FACILITIES THAT HAVE NOT BEEN PAID SINCE JULY. MAYBE THEY SHOULD MEET THE EMPLOYEES WHO CAN'T GET PAID BECAUSE THE FACILITIES HAVE BORROWED ALL THEY CAN FROM THE BANKS. MAYBE THEY SHOULD EXPLAIN TO THE DEVELOPMENTALLY DISABLED ADULTS WHO LIVE THERE WHY THEY CAN'T GO TO THE DOCTOR BECAUSE THE DOCTORS WON'T SEE THEM WITHOUT BEING PAID UPFRONT. WHY THEY CAN'T GET THEIR MEDICATIONS BECAUSE THE PHARMACIES CAN NO LONGER AFFORD TO SEND OUT PRODUCT WITHOUT BEING PAID. MAYBE THEY CAN EXPLAIN TO THEM WHY THEY CAN'T HAVE BREAKFAST, LUNCH OR DINNER BECAUSE THE GROCERY STORES WILL NOT LET THE FACILITIES BUY GROCERIES ON CREDIT. MAYBE THEY CAN EXPLAIN WHY THE CLIENTS WILL HAVE TO MOVE OUT OF THEIR HOMES BECAUSE THE LANDLORDS CAN NO LONGER TOLERATE NOT BEING PAID THE RENT. MAYBE THEY CAN EXPLAIN WHY ADMINSTRATORS WHO ARE NOT TRAINED TO DO DIRECT CARE ARE THE ONES TAKING CARE OF THE CLIENTS BECAUSE THERE IS NO MONEY TO PAY THE STAFF. MAYBE THEY CAN EXPLAIN TO THE STAFF WHY THEY NO LONGER HAVE A JOB, WHY THEIR CHILDREN ARE GOING TO SCHOOL HUNGRY, WITH TORN CLOTHES AND NO SCHOOL SUPPLIES WHILE IN THE MEANTIME THE SENATE IS GOING TO WORK IN SILK SUITS OR VACATIONING IN TAHITI. IF THE CONSTITUENTS DON'T MIND THE 1% SALES TAX INCREASE, WHY DO THE ELECTED REPRESENTATIVES CARE. BECAUSE IT IS A GAME TO THEM. BECAUSE THEY ARE PLAYING LETS SEE HOW POWERLESS WE CAN MAKE THE GOVENOR AND HOW BAD WE CAN MAKE HIM LOOK. GROW UP AND START LIVING IN THE REAL WORLD.

As a republican, i am proud that those 15 republicans voted no on this budget. Screw the poor, they never vote for "republicans" anyway. Until and unless we get exactly what we are demanding in this budget, it will not be passed. This can take another day, week, months, years. It don't matter to us, no budget will be passed, till we the "republicans" get what we want.

It's just another example of politicians acting like children. Seeing which one is the top dog on the playground. While state workers and the people who rely on our services are the ones who suffer. And by the "Republican" learn a little grammar. The phrase should read, "it doesn't matter to us". Not, "It don't matter to us." How can we take your divisive comments seriously, when you can't articulate them.

As a PROUD DEMOCRAT and against these stupid republicans that keep going agains the budget it is time for us to call our democratic congress and e-mail the Gov which is stupid Gov. Schawetsahater and have him the sign the state budget and get it over with. Cuts are being made like crazy and health care benefits are going down the drain like crazy, and businesses are closing their doors because their is just not enough money to pay the employees because there is no budget at ALL! This is crazy! 60 days without a budget and none of these people no what the heck they are doing! Us californians need to make a move and stand up and say SIGN THE BUDGET!! I am in college and a struggling student. The college where I had attend to had to borrow money to pay the teachers and staff because there is no money at all! What the heck is going on? On June 20th I sent off my Renters Assistance packet and this relies on the budget to get signed and so far nothing! PLEASE FOR GODS SAKES LETS GET THIS BUDGET SIGNED! It getting really annoying not have a budget. Law enforcement agencies are cutting back and firing people that have been there for a long time because there is just not enough money to pay the employees. People are losing their houses left and right because they cannot afford the house payments. Its rediculous if you ask me.

We need to get this budget signed and over with! I am a proud democrat and it seems that these republicans do not give a DAMN either way!! People are losing their jobs left and right and health cuts are happening like crazy!! Schools are having cuts as well and angry parents of those cuts at the schools are protesting. Time for us Democrats to make a move!

I closed my business Friday and Have a buyer for my hom, good bye California after 30 years I am tired of starting over. Enough. At 53 I dont have enough time to take another chance on California. I have waited over 20 years to see changes, I have all for the worse. Cant be self employed small business owner here.

This is so insane. My boyfriend works for a group home for diabled adults. Its not ONLY affecting us, with our daily needs to live..BUT to our clients...How are the owners of the group home suppose to FEED and properly cloth the people who rely on them the most?!!!!!!!!!?????? I wish i was on the board sometimes. The way they are running things are rediculous. We are all struggling!!!! PASS THE BUDGET SO WE DONT HAVE TO WORK FOR FREE ANYMORE, AND SO WE CAN LIVE and NOT LOSE OUR HOME. WHAT IS THE HOLD UP? I AM SO MAD AT THIS WHOLE THING!!!!!!!!!!!!!!!!

This whole thing is really upsetting to everyone! Makes one wonder what's next. It's really getting scarey. Something needs to be done and SOON. I'm still waiting for my renter's credit check which I won't get until things are signed and I also had trouble with my school grant. It's pathetic
