Schrag: Federal DREAM Act Up for Vote Today--Why Isn't Schwarzenegger Demanding Its Passage?

A bipartisan group in Congress has been struggling for years to pass the federal Dream Act, which would allow an estimated 360,000 young illegal immigrants who are recent graduates of U.S. high schools – many are now in college – to get on the track toward legal residency. An estimated 45,000 live in California.
The act is scheduled for a cloture vote in the Senate today. If it gets the required 60 votes – hardly a sure thing – it would head off the filibuster threat that conservatives have used to block it before.
The act covers students brought here by their parents as young children. Many don't speak their native language and know little about the country where they were born. Collectively they represent an investment of some $18 billion-plus in their American education.
Despite that education and their almost total assimilation into American culture – Americans in all but the right to call themselves that – they live in the shadows, can't get the jobs their skills qualify them for, can't get driver's licenses and worry constantly about deportation to places they don't know and to which they desperately don't want to go. They study in the hope someday things will change.
The Senate sponsors of the Dream Act – short for the Development, Relief and Education for Alien Minors Act, a concoction cooked up for the initials – include Dick Durbin, an Illinois Democrat; Chuck Hagel, a Nebraska Republican; and Richard Lugar, an Indiana Republican. (It's also supported by California's two Democratic senators.)
But a minority of congressional hard-liners, echoing the blog and talk-show frothers who call it amnesty for the alleged crimes of the parents who brought them here, have beaten back every attempt to pass the act. It's Old Testament redux: punish the sons for the sins of the fathers. What crime did the kids commit? The paranoid fringe also issues dark warnings that once the kids meet the stringent conditions of the Dream Act, they'll sponsor parents, sisters, cousins and aunts, thereby opening the gates to more immigrant hordes.
That's nonsense. The visa backlog for siblings is decades long. And illegal parents would have to return to the home country for 10 years or more before they would have any chance of returning legally.
As for the kids: To get a conditional residence permit under the act, they have to have arrived here before the age of 16, lived here for at least five years, have graduated from a U.S. high school, have good moral character and commit to attend college or serve in the military for at least two years. Those who meet those commitments may then become legal permanent residents. Those who don't fall back into their illegal status.
The bill is also limited to the present generation of students. No one who's been here less than five years at the time the act is passed is eligible.
There are all sorts of ways in which current U.S. immigration law is self-defeating. But there can't be any better illustration than a system that tries to force ambitious and committed U.S.-trained people out of the country at a time when both employers and the military desperately need them.
The employers warn that they'll be forced to outsource more skilled jobs, warnings reinforced by data indicating that there aren't enough Americans in our educational pipelines to replace the boomers who are now starting to retire.
Just last month, Gov. Arnold Schwarzenegger and a bipartisan group of other governors sent a letter urging congressional leaders to make it easier for U.S. industry to bring skilled foreign workers to this country and get them to stay here.
That, they said, requires more green cards and more H1-B visas to "keep employers in our states and ensure there is a skilled work force in this country to fill their immediate needs." Because of today's shortage of visas and delays in processing applications, "more and more of these talented individuals leave their U.S. jobs and return home."
If that need is so great, why aren't Schwarzenegger et al. also demanding passage of the Dream Act? Repeated queries to the governor's office produced a blank. Worse, despite the thousands of students who've been petitioning Congress, no one in the governor's office seems to know what the Dream Act is.
The premises of the governors' plea for more visas may be overblown. In the past decade, some unemployed American engineers and other high-tech workers charged that there was no real shortage in available U.S. workers. The shortage, they said, was artificially cooked up by employers laying off better-paid Americans and then demanding more visas to import cheaper foreign workers.
But if there's any substance to the warnings about skilled labor shortages the Dream Act could play a central role in addressing it. At a time when there's no end of rhetoric about our low high school graduation rates, why are we trying to drive those we have educated out of the country?

Why the special treatment?
Some of us once had dreams of our own.
Back in the 60’s the Federal Government came into the public schools and brainwashed us as little children with the message that the children we were about to have were unwanted because the population was rising so fast. They launched a program called, “Zero Population Growth”. They pushed Family Planning and birth control pills. Now they call the same programs, "Safe Sex" but the results are the same. I think you and I both know that you only have to trick people for their few child bearing years and there is no going back.
Many of us never had a say in the future of our unborn.
I am the result of two living cells. One from each of my parents. They are the result of two living cells, one from each of their parents. I wasn't just born. I am a continuation of life. I am a living thing that reaches back into time perhaps 400 million years and the result of billions of joining of pairs of cells. It is possible that if you were to follow my cells back to my parent’s cells and beyond that my family tree touches every living thing here on earth. That is if we limit ourselves to believing life was created here on earth. If it rained down from the immensity of the universe it could reach back into that immensity of time and space, and who knows what relationships and who knows what species.
My family line succeeded, at least until I came up against the Federal Government and their plan to control the population.
I have seen the Federal Government do little else to control the population.
The open border, United States laws only apply to some, is a serious slap in the face. No, not a slap in the face, it reaches well beyond that. Maybe back to the beginning of time and stretch to the bounds of the universe.

Yes, the dream act must be passed. I know kids who are almost done with college and are about to receive their bachelors. They have a right to stay in this country and work. They did not choose to come here illegaly. They are not asking for financial aid...you can keep it. They just want a chance to put their degrees to use, a degree they have worked so hard for.

This is called the Dream Act and it covers the children of illegals. Where is the act that covers the children of legal residents? I bet it is called "To bad your parents got here legally, now you have to wait behind those who broke the law to get here to get help for school."
Why do we have to give an edge to those who break the law to get here, but not those that were born here? I am so sick and tired of our government wanting to give aid and comfort to those that broke our laws while they shun all those citizens who were born here or got naturalized legally.
Why should the government give free health care to illegals, but I had to join the Army to get my free health care. I want all of you on the left to answer me that one!

Is time to change our ways of thinking, we are a really selfish society, and is time to not only think about our selves but about others too. Sure we all pass to hard times, but right now is the moment to help those people, the undocumented college students. when the government is going to start thinking about their citizens and stop thinking about others? They won't, so we should at least be glad they are doing something for someone. How would this law affect anyone? It wont it only has positive outcomes. What kind of society are we, when we fight for good things to not happen and we don’t even bother glancing at the bad ones happening. Let people be happy!!! The dream act should pass.

A nightmare not a DREAM!
I am an unemployed computer programmer. I have a master’s degree in engineering. You would think that with training and experience in a profession in which there is such a shortage that well need “more green cards and more H1-B visas to ‘keep employers in our states and ensure there is a skilled work force in this country to fill their immediate needs’” that I could find a job. No can do. Why would anyone hire an American when foreigners are much cheaper? And do not think that the law gives Americans any protection:
“H-1B workers may be hired even when a qualified U.S. worker wants the job, and a U.S. worker can be displaced from the job in favor of the foreign worker.”

There is a prevailing wage requirement in the H-1B law but when employers do what the law says it just turns out that the save about one third of what they have to pay Americans. I think that is called a loophole.
The DREAM act is a nightmare for a lot of Americans. Just one more way our government is working hard to give American jobs to foreigners.

This is the time for them to accomplish their dreams. they just want a better education and remember one thing it won't affect anybody because we only live once and this is something that maybe you care, but after that, everything would be gone.

They have a right to stay here?
You may think that they "should" have the right, but don't make yourselves look stupid by saying that they "DO" have it. THEY DON'T! Plain and simple.
All you who think that they should get to stay here, are just saying to the millions of people who want to come here "LEGALLY", that they should give up on doing the right thing, and jump the fence instead. At least if we sent these illegal aliens home, we'd be sending them home with a college degree, then they could apply to come back, just like everyone else.

I believe you mean "When is", either way there are so many things wrong with what you just said.
The only purpose a government exists is to think about their citizens and what is best for them. If you are really so altruistic then start your own charity organization for foriegners, it's not the governments purpose to offer opportunities. It's just to protect it's "CITIZENS", and keep the rule of "LAW".
Will you people ever understand... It's not about mean and nice, or racism, or even charity. It's about the fact that everyone in the world wants to come here. Everyone of you who thinks we should let the illegals stay here is giving a big F.U. to the starving people in Somalia who don't have the option to jump our border and live here illegally. Your basically racist against all the poor people in Africa. "Oh well, screw you Africans, until you find a way to cross the atlantic, and hop the Mexican border, we don't give a crap how bad you want to be Americans."

That sounds more like the legislature, and more specifically the 'appropriations commitee' need to employ more people so that there is no backlog.
I believe the congress is controlled by the democratic party so you would think 'increased funding' not to be an issue. Unless of course there is reason for Deocrates NOT to employ enough people to process applications.
I've read here (and in a previous article) a number of statements that somehow it is too difficult to obtain legal status. Others state that was not difficult at all.
Whether its easy, or next to immpossible, I would gather that its somewhere in the middle.
Certainly a simple search online reveals several ways to become legal using free governmental programs.
At least one, http://www.usagreencardcenter.com/ allows one to be a US resident to apply. And I'm sure there are others.
And yet 1000's, of not 100,000's every year seem to manage with the process and become legal.
As nobody want kids to be at a disadvantage due to their parents, one must wonder why this state hasn't begun to help in some way. (Albiet, in a way that doesn't provide freebies.)
Somehow I doubt it will pass in congress as well, unless it was soley a simple amnesty for those under 16. As written, that is unlikely.
I would think those in primary, or secondary schools might benefit from being informed about programs to obtain green cards. I would think it simple to review ID#'s in school, and add a flyer, (or application) to any mail so that such students/parents can begin to plan ahead.

There are tens of millions of people around the world who would love to come to the USA. They stand in line for an oportunity and do it legally. We should we reward these cheaters and children of cheaters. Stop the flow of illigal people BEFORE more hand outs.
Illigals childeren get Free: Education,Healthcare,Lunches,Transportation just to name a few.
The only transportation we should give thim is a ride back to the border.

There's something I would like to remind all of you who are either castigating the children of undocumented workers, or raising the zero sum argument that there are others--citizens, lawful immigrants, etc. who go wanting (presumably if these children get benefits), or calling it a free ride, etc.
That is, that there is much more here than the actions of the aliens and their children who have come here. There are the complicit actions of businesses from large corporations to small family businesses and of those who want their lawns cut, dangerous work done, houses renovated, and other tasks performed and who pay these folks from other countries to work.
There is something fundamentally unfair, it seems to me, to take the labor of others, have them living in our country and state, paying taxes (even if paid under the table--which I don't condone) but nevertheless paying sales taxes and other taxes whenever they buy something, and also in many cases paying income taxes and Social Security taxes and then telling them basically to get lost.
And as far as their children are concerned--those who have excelled in high school here in California and resided here for the required number of years under the DREAM Act, to then tell them they cannot get an education that they have qualified for--on the basis of their hard work in school.
I don't think this is a zero sum game where we have to step on other people to elevate the rest of us. I reject the zero sum argument.
Given what we have had as a pattern for years, with our very own involvement in it, it seems to me that we as a society have an obligation to them.
That does not mean that we need to have an open border and that we should, moving forward, have unlimited immigration. But it seems to me that this is part of the bargain--the social contract if you will based on the fact of what has happened--that we need to fulfill.

ILLEGAL Aliens!
Sure it is a zero sum game. Our taxes are not paying the bills. Our Schools are overcrowed and need more money, Our healthcare system is broken, Freeways are jammed and the state is broke. All this while the average legal American is working harder, both spouses just to keep the family running, paying more taxes and getting less services.
Very simple close the border first.
The business owners who hire Illegals should be put in Jail as well!

Frank, the federal government tried to crackdown on employers...a liberal judge stopped it...
You are asking me as a single parent with a child to foot the bill for to please be happy with continuing down the path of supporting illegals...not happening...I have no responsibility to anyone who is here illegally. You are missing the who point of this bill, it is not just for "the kids" as pity Durbin wants to purport it is entry for every member of their family I.E. AMNESTY!!!!-read the bill, and also the congressional budget on how many illegals it would bring into the country. Gaping holes, which by the way even the president sent a statement to the senate floor saying he did not support this act..it has to be pretty bad....
Americans are on record for being the most giving people in the world, but we are tired of giving up our rule of law...and eventually our sovereignty if this pattern is not halted. I am an African-American Frank, do you think I run around feeling entitled because my race was treated badly? No, they must follow the rules. This act was unfair to those people who have done it the right way...those who have been living here going to school, have certainly educated themselves enough to start becoming legal citizens..what exactly is the holdup? Are they waiting for more handouts? or are the Dems wanting more votes?
I am sick and tired of being told illegals are "our responsibility" illegal means illegal-gotta start somewhere!

Russo: No one, well at least, most of us don’t want to see undocumented kids NOT become educated, or fulfill their dreams. I have two graduate students working in my lab who are not from this country. They do excellent work. I will be sorry to see them go.
From what I’ve read, that’s not the concern.
Part of the concern is that ‘zero-sum’ perception you have mentioned. I’m still not convinced the benefits of undocumented aliens outweigh the consequences of having illegals in prison (which CA refuses to tally). Or so-called ‘emergency’ medical surgeries (Chemotherapy, Cancer treatments) that the state pays for that must amount in the Billions. Or other social services that increase the cost for natives.
Both parties will need to overcome that perception with most Americans to make progress in the future. This is especially true in California, and with how conservatives perceive the Democratic Party. Sanctuary cities come to mind, and the inability to stop subsidizing every wish list in terms of spending.
It will come as no surprise (to me) when the Dream Act fails nationally.
If the proponents really want to help undocumented kids (so that they can be tax-paying productive members of society), then common ground will have to be found that most Americans can support.
Any law that has a chance probably will need the following: And it will need to be minimal, only addressing the specific issue.
1. Amnesty for kids under 25 (college graduate age and below) to become legal residents. That person must submit some paperwork verifying that they have been in the country since near the time of birth. (Diploma)
2. Any law likely to pass would NOT allow you to qualify for Calgrants, financial aid, or other financial subsidies. Paying your way through school can be done.
3. That amnesty will not extend to parents, or to other relatives. This cannot be a backdoor to legal status for parents or other relatives.
No doubt the immigration laws need to be overhauled. Also, keep in mind, the current president is at least willing to push for it. That may not be so depending on the next election.
For Schrag to suggest that many are waiting for the situation to change, that may be another 5 years, another 10-15 years, or forever. The only reasonable thing is to get those who can become legal, to try. And to try again, and again until successful.

One word Jeff....Democrats..they pick and choose where they pop-up,notice..you never saw them in NJ when the illegals shot those three blacks.....why?? because that would not have been supporting their party...disgusting I have absolutely no love for either one. They are opportunists, I have trouble identifying with the African-American community when it comes to politcal issues because they are mostly democrats, or they have never taken the time to understand issues that affect the nation as a whole..not just the race related ones. I think they need to begin to understand the impact that illegal immigration is having on their life, instead of identifying with them..that concept I don't understand either. I have made it my business to protect my daughters interest and the American ideals we are so generously afforded in this country...I don't personally think very many African-American share my views-- but I believe all Americans are ready for the fight we obviously are going to have.

I stand corrected. I just read the bill. Most of what I suggested is already part of it. Except I would probably not have allowed the sponsorship of relatives EVER, not just after 6 years.
If the bill is amended to avoid possible fraud from anyone claiming when they entered the US, it might just have a chance.
Report cards can be re-printed up from primary school. That should be easy enough for anyone.
Serves me right for not reading it first.

If the children of Mexican illegal aliens want to pursue their DREAMs of going to college they can do so for free in Mexico. National Autonomous University of Mexico is free to Mexican citizens.

jhm: That hardly helps students who don't speak Spanish. Remember some of these kids have been in the US since they were toddlers. Many consider the US as their home. Nor does that help those who came from other latin countries where going back in not an option.
As predicted, the Dream Act did not make it past the closure vote in the Senate. Nor will it unless its scope is minimized even further.
As Schrag has mentioned, students have been waiting for years for something. As anyone can filibuster in the senate, 5,10,15 more years may go by before anything passes.
The current President is at least favorable to anmesty for that select group. It would be wise for Democrates and Republicans to find common ground and pass something.
Then a more comprehensive reform on the immigration policies in this country can (and should) be addressed. Then again, I'm 'moderate' so what do I know.

Most Americans would love to help these people, but the masses are not going favor anything until we can control our borders. We need to crack down on the people who hire Illegal's and finish the fence. With the open border it is going to turn our State and Country into two classes the rich and the poor just like (Mexico)!

I think they should pass the Dream Act because it's not the children's fault that their parents came to US to work hard and be able to support their families. I have respect for those undocumented parents who don't harm anyone and who work so much even drive without a license just to give the best to their children. Yes they did wrong by crossing the border illegally but everybody makes mistakes and i think atleast the kids should have a chance. I extremely disagree with JEFF and LASONYA i think its good that you're tryin to voice your opinions but U really are cold hearted people.
