Sex Offenders Shunted Into Small Republican Rural Towns – By Republican Lawmakers?

Well, they insisted on it. Wanting to look “tougher” on crime than the Democrats, the Republicans insisted on a provision that keeps paroled and other sex offenders from taking up residence within 2000 feet of a school or public park.

That’s as the crow flies.

The real world result of this provision is that sex offenders can’t find a place to live in most large California cities.

The law requires sex offenders (and other felons) to be paroled back into the Counties where they committed the offense that put them in prison. For decades this has meant that most ex-cons wind up in our large urban areas – leaving small towns relatively free of their company.

No more!

The 2000 or so paroled sex offenders released in San Francisco now have the option of camping out on Ocean Beach or leaving the County. There are NO facilities within the County limits that meet the 2000 foot restriction. Other jurisdictions will have the same problem.

The parolees have the choice of moving on or moving back to prison. The state has no relocation responsibilities.

So here they come, small towns in Northern California. Represented by Republicans in the Legislature. Red Bluff currently houses about 36 paroled sex offenders. Be fun when another 300 join them in wandering the city’s (few) streets.

The new law only affects recent paroles and new offenders who commit crimes after last November’s election – although Attorney General Jerry Brown believes it should apply to all 90,000 sex offenders in the State.

Democrats are preparing bills to do just that.

We’ll see how tough Republicans really are….!

Bill Cavala was Deputy Director of the Assembly Speaker’s Office of Member Services where he worked for over 30 years.

He attended undergraduate and graduate school in the 1960’s and received a doctorate in political science at UC Berkeley. He taught political science at UC Berkeley during the 1970's while he worked part-time for the State Assembly.

Cavala left teaching at UC Berkeley and went to work for Assembly Speaker Willie Brown in 1981 until his tenure as Speaker ended in 1995, and he has worked for his five successors as Speaker up to and including Speaker Fabian Nunez.

Mr. Cavala manages election campaigns for Democratic candidates.

Given the recent string of sexual transgressions by Republican members of Congress, it does seem somewhat fitting that these miscreants be housed in heavily Republican areas. Joking aside, it would be nice to find ways to identify and neutralize these guys (and they are primarily male) before they commit sexual assults. It would be better for everyone, including them (I'm assuming neutralize is not physical extermination here). If we had a functioning mental health system, maybe treatment could be instigated before they give in to their urges. Guess that wish makes me a liberal, eh? Better to put them in Republican areas.

Will these rules also apply to Bill Lockyer's former bodyguard-and-running-buddy Myron Richardson (working as DOJ protective service agent) that was arrested/convicted for statutory rape?

Seems he got very very favored treatment. Ask at DOJ and they all clam up.

I hope Lancaster is filled to the brim with sex offenders since the authors, Sharon and George Runner, live and represent the area. They can explain to their constituents how wonderful this ineffective and unconstitutional law really is. By the way, does any one know how this law can apply to parolees who were released after its passage since they had already been sentenced? Doesn't that violate ex post facto law?

Jessica's Law was poorly thought out when it came to the living restrictions. Similar laws in Iowa have failed. It appears that it is starting to fail here because recent parolees are having trouble finding housing in their counties.

Democrats should leave the other 90,000 or so sex offenders alone. They are already living under the toughest laws in the nation. Living restrictions do nothing to prevent new crimes from occurring and forcing those that have already served their time to move will only add to the problems we are just beginning to have.

To all our Democratic representatives heed my advise. Don't do what your Republican counterparts did...they shot themselves in the foot with Jessica's Law, don't do it to yourself by trying to be tough on crime by coming up with laws that will affect those that have already served their time.

It's really disturbing to read that the Democrats are preparing bills aimed at those offenders that have already served their time and are not on parole of probation.

Many courts across the U.S. are finding these living restrictions unconstitutional when applied retro-actively. These restrictions do nothing to protect our children. It has already been proven that these feel good laws do more harm than good. These laws are being written and passed based on emotion and not facts.

The State of California pays taxes so that sex offenders in question be evaluated by two DMH State psychologist six month prior to being released. So why is it that they are out in society after it was determined by the psychologists that there was'nt a likelihood that he/she would re offend and are still being punished by having to ware a GPS monitor, residency, restrictions, etc.,and was never convicted for child molestation, and the sex offence was committed decades ago. Sounds like vigilanty laws to me and another way to keep big time bucks coming into the pockets of those law and order guys. But justice will prevail! You tried to sneak those unjust laws under Jessica's Law hoping that no one would challenge it, but it backfired on you just like the 'THREE STRIKE LAW' did! What you need to do is make your wrongs RIGHT! And apply your laws the way they should be applied and to those they should be applied without first respecting the DUE PROCESS RIGHTS OF THOSE WHOM YOU LABEL AS A 'SEX OFFENDER'.
