GOVERNOR SIGNS SB 1379 (PERATA-ORTIZ) TO CREATE NATION’S FIRST STATE BIOMONITORING PROGRAM

We monitor our air and water for pollution. We monitor fish for mercury. But we don’t monitor ourselves to determine what chemicals we have accumulated in our bodies.

There are an estimated 100,000 chemicals that are registered for use in the United States today, and another 2,000 chemicals are added each year. Some toxicological screening data exists for a slight 7 to 10 percent of these chemicals. But more than 90 percent of them have never been tested for their effects on human health.

That’s worrisome enough, but it’s downright scary when we realize we are bombarded by chemicals on a daily basis – those in our cosmetics, personal care products, pesticides, food dyes, cleaning products, fuels and plastics.

California and the nation are experiencing dramatic increases in chronic diseases and illnesses. Studies increasingly show that certain toxic chemicals contribute to the development of cancers, asthma, learning disabilities, endometriosis, birth defects, infertility, Parkinson’s disease and other illnesses.

How can public health advocates and medical experts possibly get a handle on the causes of those diseases without knowing what we have been exposed to, whether it has accumulated in our bodies, and what that impact on our health may be.

On Friday, Gov. Schwarzenegger signed SB 1379, legislation I co-authored with Senate President pro Tem Don Perata (D-Oakland) to establish the nation’s first statewide biomonitoring program. Once again, California is on the cutting edge in the nation.

This bill will require the Department of Health Services and the California Environmental Protection Agency to establish a program to monitor the presence and concentration of designated chemicals in California, chemicals that are known to, or strongly suspected of, adversely impacting human health or development.

Their work will be assisted by a Scientific Guidance Panel, whose members will be appointed by the Governor and legislative leadership. The goal is to study biospecimens – blood, urine, breast milk, hair – from a broad base of Californians who volunteer to have their “body burden” tested. These individuals will represent California’s ethnic, economic and geographical diversity. Individual results will be strictly confidential, but available to those volunteers who request their personal information.

This data will help us begin identifying “hot spots,” whether they are breast-cancer clusters in Marin County or pesticides in the bodies of children of Central Valley farmworkers.

This has been a long journey, one that started five years ago, when I chaired informational hearings on the need for a state biomonitoring program. Due to intense opposition from the chemical and agriculture industries, the chamber and others, several bills to establish the program failed to make it out of the Legislature. Last year, a bill very similar to SB 1379 finally landed on the governor’s desk, where it was promptly vetoed.

But this year, armed with even more alarming studies such as the Environmental Working Group’s report that even the bodies of newborns show high exposures to a variety of chemicals, we were able to prevail. Thanks to the hard work of our sponsors, the Breast Cancer Fund and Commonweal, as well as a growing awareness that I believe have enlightened and educated legislators and the governor, we finally prevailed.

This is a right-to-know law. We have the right to know what we are exposed to, and what we carry in our bodies. And, importantly, that basic information will provide building blocks for scientists and medical experts to better protect our health.

Biomonitoring is the first step in what our sponsors have dubbed “the next generation of public health policy.” By identifying disproportionately affected communities and linking environmental exposures to pollution-related disease, we can all look forward to a healthier California.

There are just too many people sick and dying from chemicals that are supposed to make our lives easier. It is so important to become aware of all of the toxic materials in our world and keep up the fight against companies like Monsanto and others which have no qualms about poisoning the world so that they can become and remain multi-millionaires. These people are ingesting and killing themselves too in their quest for riches. Why are they given the right to totally ignore the health of our people and planet?

Use chemical free personal care and cosmetic products. Women ingest about 60 different chemicals each day before they walk out the door unknowingly with their cosmetics and personal care applications. Men use less but are still using deoderants and shampoos. etc. Our young folk are also as much at risk. Mixed together these chemicals are unknown in what they do in the body.
The planet is better for it to without these poisons going down the drain from the average household around the world. We can all do a bit to help. Sounds real good. For the sake of the children no doubt. How ya' gonna feel when those checks are mandatory? And then again when it's mandatory that you take what they tell you to take to 'get better'? You wanna bet your life that the state will keep you safe?
Since Americans spend so much money on health care, they should be getting a high quality of care, right? Unfortunately, that's not the case. Of the 783,936 annual deaths due to conventional medical mistakes, about 106,000 are from prescription drugs, according to Death by Medicine. That also is a conservative number. Some experts estimate it should be more like 200,000 because of underreported cases of adverse drug reactions.
California has never been on the cutting edge of anything. EVER.

Craig is right, soon it will be mandatory (as will chip implants, for 'medical reasons'). The 4th Reich has begun. Already the gestapo detains demonstrators, bans books like "America Deceived" from Amazon, conducts warrant-less wiretaps, uses false-flag operations (9/11) and starts illegal wars based on lies. We are the new Hitler. Much of Germany did not know what was going on until it was too late. We can probably agree that the WWII German populace was far more intelligent that today's average American. How long until they realize? Don't impede science but maintain skepticism of our gov't using good science for evil.

I'm glad to see a number of people reading this article by Senator Ortiz. This is a very important new law in California that will allow us to find out about how environmental toxins are getting into our bodies. While some of you may actually believe that "ignorance is bliss," it is important from an individual health standpoint to be able to know what is going into our bodies involuntarily, and also will help in the shaping of good policy on public health issues.

5th - I'm insulted by your 4th Reich comment. We still have rights in this country including the right to vote...the 1st, 2nd, and 5th Amendments. To draw a moral equivalent between the US and Nazi Germany is faulty logic at best and drone-think at worst.

Frank - I couldn't disagree more. "...law that will allow us"...as though it wasn't allowed before? Yes, and for damned good reason. "Us" refers to whom? A government bureaucracy to collect data on its citizens? What will done with this data? I can see plenty of lawyers cum politicians-to-be rubbing their hands with glee over the windfall of control they are about to have over our collective lives. Free individuals don't need unknowledgable nannies like Deborah Ortiz or Don Perata telling the public what they can and can't ingest. I will guaranty faulty conclusions and bad politics are the ultimate result. If you want to know what's going on in your own body, grow your own food in your own back yard and pay a lab to analyze the samples. Don't ask me or others to contribute. Be more self-reliant. The government's only responisibility to anyone is to defend the borders and enforce the laws...not saddle its citizens with onerous legislation. Period.

Sadly, both sides of the aisle are far too intrusive in the name of "the public good". This is just another piece of legislation that fosters the nanny-state.

Where did you get that from - Monsanto? Take a look around you buddy, go check out younger students as they leave school. Overweight kids used to be in the minority when I was a student, now the thin one's are. Check out the diabetes rates, as well as a lot of other disease rates, skyrocketing. The upcoming generations will become further enslaved to a world of hospital visits and prescription medicines which are toxic and only treat symptoms, all the while worsening their overall health. You are right about one thing though, if you look to the government for answers, you are a fool. A good place to start is Mike Adams' website, www.newstarget.com. Educate yourself, treat yourself, cook yourself, and for crying out loud, get some outdoor exercise on a regular basis. I take care of my aging parents, and spend a lot of time in the hospital. Doctors and nurses don't look to be in much better shape than the patients they treat. If you look to that system to take care of your health, you are making a big mistake. Do away with the standard household cleaners you use, don't eat junk food or processed food, buy local, preferably organic produce, and MOVE your body!

How stupid are you buzz...whens the last time we had a govt. that did not rig the elections...you can bet it will happen again.What kind of Govt. finances the weapons research of sworn enemies. 95Million went to North Korea to build the reactors that enriched the uranium to build there bomb.Bill Clinton in Arkansaw allowed the building of factories to produce arms for the contras...with money made off the sale of narcotics on our streets.We have the right to protest this system without fear of reprisal...or disappering...only this is

Doug G. - check my words carefully...I said they live longer (as say compared to the 1920's or even the 1960's), not that they are healthier. Check here: http://www.infoplease.com/ipa/A0005140.html . I made a bold assumption/conclusion that chemical advances must have prolonged life (mis-use excluded). It sure wasn't the introduction of fast food! While health and longevity are related, they are still independent issues. Many of the health problems you note are a result of genuine ignorance, and poor choices despite the known dangers of poor diet and lack of exercise. Amen to the rest of your comments.

Serpico and Anon. - I share your sentiment. This law is dangerous for what it may lead to - chips, compliance, enslavement, etc.

Mike - I saved you for last. First, I don't consider myself stupid...fallible and educable, but not stupid. I might add the Arkansas is spelled with an "s" at the end, not a "w". And Ronald Reagan, not Bill Clinton is your protagonist in the Contra drugs for arms investigation. Let's just say I don't buy your representations of fact, and I have excellent reasons for not doing so. As for rigging elections, gerrymandering - a form of rigging (if you are a cynic) has been around as long as we've had a representative republic. It's a fact of life you can't change. You can accept it that way, or jump up and down and be angry at everyone your whole life for an issue beyond your control. What a waste of a perfectly good brain. Yes, there are pockets of voter fraud, but there are too many checks and balances to allow that to be the norm. The norm is honest elections. Were it consistently any other way, the guy with the least popular votes going into the election would ALWAYS win. Point is, I am pretty sure my vote is counted along with 150,000,000 +/- others in any national Presidential election. Last point - I assumed you are talking about people being held at Guantanamo Bay as enemy combatants. I disagree with G.B. on many issues - education bill, farm subsidies, immigration, and including a few aspects of the war on terror. There are millions of people in the country who disagree with him too on those issues you bring up. But we are not all in Gitmo without probable cause. Just a reminder...those people are not there for traffic violations. They are there because they are radical muslim males between the ages of 18-45 that were either captured on a battlefield or have expressed in some way their desire to do further destruction to U.S property and people in a time of war. You say only Congress through the will or the people has the power to declare war? Wrong, they can abdicate it to the President, which is what they did on October 11, 2002. Shame on us for not being more resolute in our thinking other than "the government must do something." Both sides of the aisle are wrong on this.

Which brings me back to my original point: Governments' job is to protect the borders and enforce the laws. Period. The government has no business intruding into anyone's bio-makeup in the name of "the public good" or because some dependent class clamors for the government to "do something" about chemicals. Again, this goes for both sides of the aisle.

Okay, the Government is not protecting our borders and is not enforcing our laws regarding illegal immigration. I wonder if that has anything to do with the upcoming North American Union (which will combine Canada, the U.S. and Mexico) and the NAFTA Super Highway.

After all, was ICE/Homeland Security around for any of those massive "La Gran Marchas" (many of whom were waving many Mexican flags, turning our flags upside down and carrying signs that were of Communist groups such as: A.N.S.W.E.R, Che Guevarra and any red flags with the Upraised Fist sign?

Or the Mexican flag being raised above the CA Maywood Post Office or in various places around CA during "La Gran Marchas"?

Or businesses, Chamber of Commerces, churches, politicians flagrantly supporting illegal immigration knowing full well their "Plan de Aztlan"?

Second, I have MCS. Now the question is: So we are going to be monitored for toxins accumulating in our bodies, now what?

How will doctors actually treat the ones sick like me with MCS and those with Gulf War Syndrome, Agent Orange, Chronic Fatigue & Fibromyalgia?

Will we still be met with ridicule, disdain & discredit? The medical field (along with the drug/pesticide connection) and certain P.R. people such as Stephen Barrett (Quackwatch), Ronald Gotts (ESRI), Elizabeth Whelan, Michael Fumento (Hudson Institure) and Stephen Milloy (formerly of Cato Institute-Junk Science) all claim:
We are psyschosomatic lazy Malingerers, have "Have Mass Hysteria" and want money, control & special attention.

What Special attention?

Then we have good ol' Dean Edell and John Stossel (Give Me a Break) who both normally give very good advice slip in this periodically from time to time: "Chemicals can't harm you" and "We with Fibromyalgia, MCS, Sick Building Syndrome and Gulf War Syndrome have: Psychological problems and we need to have cognitive training.

The typical scenario for people like me is: Go in and see an allergist who runs tests (which check out normal or negative) and we get referred to psychiatrists.

Well, NOBODY is checking out Martin Pall's work such as: the Depletion of nonexistence of certain detox enzymes such as Paraoxenase and/or Cholinesterace, the P450 Pathway or the Blood-Brain barrier.

Why is nobody questioning why: Some people can some like trains and drink like crazy and be perfectly fine and those who didn't imbibe are the ones who fell ill?

Is the ONLY reason for this psychological or that we had unresolved bad childhoods?

I was watching the Discovery Channel and apparently fat biopsies were taken from: Orca (in the Seattle Area), Polar bears and seals and they were heavily laden with chemicals.

My question is: Does anybody really think this is isolated to only polar animals? Does anybody this is only isolated to the Seattle Orca? Does anybody know that once Orcas die, they are considered hazardous waste?

So my final question is: Fine, we're tested for toxic loads. Will anything be done to help those who fell ill due to chemical poisoning or will we still be left to twist in the wind and fend for ourselves?

I think this is a great idea. I will volunteer, if possible. I have taken stringent measures for myself and my family for over 15 years to avoid unnecessary exposures to chemicals, and I would like to see how that has worked. We can chose to eat organic, drink pure water, avoid sugar, dining out, prescription or OTC meds, and avoid household chemicals, but does that really eliminate the majority of potential exposure to toxins? Who knows. The last time I had a physical the doctor called me at home that night to ask me "what is (my) secret" (ie all the numbers were beyond ideal). But this is a small window into our health, and there are many other aspects of health which need to be acknowledged in order to curtail skyrocketing medical costs and the epidemic of degenerative diseases, reaching from the oldest to the youngest of our citizens.
