Statement of Honorable Joe Baca, a Representative in Congress from the State of California

I would like to thank Chairman Herger and Ranking Member Cardin for having this very important hearing. The lives of our children and stability of the family are in danger. While it is important to review state efforts to change this destructive system, we should not do that without first hearing the personal testimony of those families that were ripped apart and destroyed by local child protective services (CPS).
That is why, two months ago, I sponsored a Town Hall Forum on CPS Reform in San Bernardino, California. The forum was held to hear testimony and receive evidence of what many parents, grandparents, and advocacy organizations describe as “a festering cauldron of fraud, corruption, abuse of power and exploitation of children.”

During the eight hours of testimony, impassioned tales of rampant abuses of power, denials of due process protections, violations of civil rights, and accusations of blatant defrauding of the American taxpayer were presented by documentation, video, and prepared statements. In addition to local and regional activists, Arizona State Representative Ray Barnes and other staff members representing California legislators joined in the forum. Testimonies included documentation of a scheme designed by state counties and service providers to “maximize the federal funding stream” through financial incentives. While this in itself is not irregular, the focus on revenue at the cost of safety may be putting children and families at risk.
The testimonies continued unabated as parents and extended family members presented the committee with documentation of violations of state and federal statutes, denial of civil rights and predation upon vulnerable children and families by child welfare workers that regularly exceed their authority.

Jessica's Law is a Republican political campaign that will do far more to harm children than to help them. In other states teens have already become ensnared in this insanity.

More than 90% of child molestation occurs within the family and friends cirle. It is very, very rare that someone "steals" a child, less than 50 children per year in the entire US are killed by a mentally ill person acting out. Compare this to 2000 children per year killed by a drunk driver.

Less than 5% of child molesters ever re-offend. This entire campaign is invented by the politicians because it is an emotional issue. This same group of hysterical people organized in a law enforcement "punishers" voting group also brought us Prop 21 which put children in prison with adults where they are being raped mercilessly. They also brought us the three strikes law.

This is just another conveyor belt law designed to keep the prisons stocked with fresh slaves so these labor unions can have jobs. Vote NO on Jessica's Law.

Don't parents realize that most sex offenders are young people who get caught up in these ridiculous laws? Don't they realize that in these kind of cases actual guilt doesn't matter? There doesn't need to be any physical evidence like DNA or witnesses, all it takes is the word of someone. This type of "crime" is accused in child custody diputes, nasty divorces cases. Doesn't matter, all it takes is an accusation and that is the end of a person's life.

Study up on the statistics here. Sex offenders and in particular child molesters have the lowest re-offense rate of all molesters. Here we have Bill O'Reilly leading this parade when he had to pay out big money in a sexual harassment lawsuit.

We don't need another war on the people and voters need to vote "no" and not be fooled into thinking it actually is going to do any good.

It will keep the prisons stocked, give jobs to the prison guards but that's about it. Mothers should tremble in their beds for their teen age children if Jessica's law gets passed. There are already too many kids destroyed for life who have been accused of being a sex offender.

According to testimony, the unwarranted seizure of children from non-neglectful homes has become a national problem of staggering proportions. At any given time, there are now more than half a million children in custody in the United States. It was reported in the forum that an estimated one out of every twenty children goes into government custody and that CPS routinely violates the constitutional rights of parents and their children in the process of their “intervention.”
Nearly one-and-a-quarter million children now come under government observation each year in America. Witnesses stated that only about three percent of the children who are seized or taken into custody were physically abused. What is even worse they said, is that the children who are taken into state custody have an eight to eleven times greater chance of being abused than those who remain in their own homes.

Although most states have laws requiring a speedy trial to test the flimsy and often anonymous allegations against the parent, evidence was given that showed that often nearly a year passes before the parent even gets a partial chance to tell a judge their side of the story.
According to the forum there is little protection for the family once a court focuses its attention on a parent. Witnesses told stories of courts circumventing such basic rights as burden of proof, presumption of innocence and rules of evidence. They routinely violate due process, and equal protection rights. The system moves into a parent’s life and does nothing to help. As news reports and evidence from the forum has shown, scandals and abuse of power exist within the family and juvenile law industry.

As evidenced by this forum, abuses and errors in judgement are common. Instead of receiving comfort and encouragement, innocent parents and grandparents are often drawn into a system that has a sub-par record of protecting the children entrusted to it.
I am hoping to learn from this hearing what can be done and what has been done to protect our children and their families. It is a good start to monitor the states and review their practices. I hope that the result of this will yield concrete steps to protect our children and families from false accusations and destructive policies within the state CPS.

No offense to Diane Booth but is it possible that you could do shorter posts and stay on topic of the article so that visitors to this site could learn the direct issues under discussion? I can see you are in pain but you overwhelm the posting area and these articles are important to several million people that will be affected by more laws under proposal to destroy even more children. If you need your posts to be that long, perhaps a link to your website would be more in order. Or several short posts so as not to monopolize the whole board. Common courtesy would be nice.

Jessica's Law will not help protect our children. It will only help protect those that live within 2000 feet of a school or park and even then there is no guarantee that will have an effect. This proposition fails to Guarantee the safety of our children. Do you honestly believe that by making people move away from big cities, that have thousands of police officers to watch over them will keep our children safe....maybe for the big city. What about all the small rural towns where thousand of registered sex offenders will have to move to? How many police officers are there? This law makes no sense what so ever. This concept already tried in other states has not worked. It wont work here. Those states are much smaller and have less sex offenders living there than here in California.

It is always tragic when a child loses his or her life at the hands of another person but sex offenders are not the only ones that have killed children. Sex offenders kill less children than drunk drivers do annually. How many innocent children have lost their lives by stray bullets being fired by gang members...I don't see them getting exiled.

Why pick on the sex offender? Remember, not all sex offenders on the registery are child molesters. This law is suppose to protect our children from child molesters and child predators but what about everyone on the registery that did not commit a crime against a child. Why should they have to suffer even more. These people suffer every day of their lives. The have to register as a sex offender for life. They are not wanted, right now, in many communities. They are having trouble finding work and yet we want to pass new laws that will prohibit where they live....my God, what's next. I have an idea...Let's do them a favor, and save the state millions and millions of dollars, let's take them and feed them to the sharks. That would be more humane than making them move from city to city and county to county to find a place to live.

"sex offender" encompasses a very broad range of people who committed a very broad range of actions. Some acts are by their very nature a sexual crime - no-brainers like: rape, flashing, etc.. others are not so black and white.

For example, would anyone here (or reading) consider the following to be "sex offender" worthy crimes?

- peeing in an alley

- changing an diaper

- taking a photo of your ONE YEAR OLD breastfeeding

- grabbing a wayward teen by the arm to give her a piece of your mind for almost making a multi-car pileup

- grabbing your own crotch and making a crude comment

- asking a lady in a bar to go home with you

- engaging in consensual teen sexual behavior

If you said YES to any one of these, you are in the minority. Most people are blissfully unaware of what actually constitutes a "sex crime" today in America - unless or until they (or a family member) get swept up in this over-broad net and ever-farther-reaching and vaguely-worded laws.

For all those instances mentioned above, there are newspaper articles published on each one - yes, each one is of a person who as been prosecuted and is now a sex offender for LIFE. The few listed above are representative of a growing number of Americans caught up in this net. It certainly makes juicy tv coverage, but it is a horrible un-ending nightmare for them *and their families.*

The current system has many glaring flaws. One of which is that the registry was initially internal - only law enforcement had access to it; it was intended to be for violent offenders. Then it took off as a tool for the public to protect themselves from those violent, repeat and habitual offenders. Now it has transmogrified into listing everyone who was ever adjudicated for anything even remotely able to be construed as sexual.

Florida is have big problems with their sex offender laws. Teens have been ensnared and ruined for life. most people don't realize that 40% of sex offenders are under the age of 20, ruined for life.

A one size fits all law never works. Three Strikes has destroyed more people than it ever protected. many laws are one strike this is all political hype and does nothing to protect children.

the foster care system is where children are getting molested why isn't the focus on that?

Shame on all of our Politicians that are supporting this propsterous proposition. They have nothing better to do than go around, California, and scare the living daylights out of all of us. You want us to believe that every convicted sex offender, it doesn't matter that their first offense was not a crime commited against a child, is a threat to our children. Do you realize how many of these people lived next door to us, without incident, before the inception of Megan's Law?
There are currently three major flaws in the proposition. 1) Predator Free Zones; we can't kick everyone out of their homes because they live within 2000 feet of a school or park. A lot of these people have lived in those homes for years and years. They do not and have not possed a threat to us or our children. 2) Encouraging Cities to add other parts of their city as Predator Free Zones...how absurd is that! We might as well act like Nazi Germany and put all convicted sex offenders in concentration camps. 3) GPS tracking devices for all sex offenders...who are they going to contract to do this "LOJACK"?
People please, our politicains are using a scare tactic for this proposition. The news media emphasizes the dangers of Internet predators, convicted sex offenders, pedophiles, and child abductions. Despite relatively few instances of child predation and little hard data on topics such as Internet predators, journalists invariably suggest that the problem is extensive, and fail to put their stories in context.
We can not let them pass this law. We already have a failed three strikes law that has put many Californian's in danger, high speed pursuits, what do you think Jessica's Law will do when we put the sex offender up against the wall...God only knows.

Much of the concern over sex offenders stems from the perception that if they have committed one sex offense, they are almost certain to commit more. This is the reason given for why sex offenders (instead of, say, murderers or armed robbers) should be monitored and separated from the public once released from prison.
The high recidivism rate among sex offenders is repeated so often that it is usually accepted as truth, but in fact recent studies show that the recidivism rates for sex offenses is not unusually high. According to a U.S. Bureau of Justice Statistics study ("Recidivism of Sex Offenders Released from Prison in 1994"), just five percent of sex offenders followed for three years after their release from prison in 1994 were arrested for another sex crime. A study released in 2003 by the Bureau found that within three years, 3.3 percent of the released child molesters were arrested again for committing another sex crime against a child. Three to five percent is hardly a high repeat offender rate.
In the largest and most comprehensive study ever done of prison recidivism, the Justice Department found that sex offenders were in fact less likely to reoffend than other criminals. The 2003 study of nearly 10,000 men convicted of rape, sexual assault, and child molestation found that sex offenders had a re-arrest rate 25 percent lower than for all other criminals. Part of the reason is that serial sex offenders—those who pose the greatest threat—rarely get released from prison, and the ones who do are unlikely to re-offend.
If sex offenders are no more likely to re-offend than murderers or armed robbers, there seems little justification for the public's fear, or for the monitoring laws tracking them. (Studies also suggest that sex offenders living near schools or playgrounds are no more likely to commit a sex crime than those living elsewhere.

John Salmon, 39, was sentenced Wednesday in federal court after pleading guilty on April 25 to possession of child pornography that had been transmitted over the Internet. Upon release, Salmon will remain under supervision for 10 years, according to the U.S. attorney for Connecticut. Salmon used the Internet to obtain more than 160 images of child pornography. Some of the images depicted prepubescent girls being subjected to sexual abuse. Investigators first traced e-mail traffic to Salmon's computer and located pornographic images in November 2003. But Salmon fled after investigators searched his home, leaving most of his possessions behind. He was arrested Feb. 3, 2006.

Jessica's Law will pass, people will see that it is more harmful than good (like they are seeing with similar legistlation in Florida). There will be lawsuits, and after years and millions in taxpayer costs, the law will be modified to be less broad.
Everyone knows this, but the Republicans don't care - they just want to exploit the issue for the November elections.

Correction - the similar legislation in my previous post is in Iowa, not Florida. They enacted the 2000 ft residency restriction and now the politicans and lawmarkers who supported it are trying to get it repealed because it has caused most of the states sex offenders to go underground.

Brandon Millar, Mark Foley should be imprisoned for life without parole. I don't know who Denny Hastert or Tom Reynolds are and I don't care. I don't care about politics either. I live in Canada. But California CPS and criminal authorities have kidnapped my only child at age six and institutionalized him, drugged him, sexually assualted him and denied us due process of law. The only ones who tried to help me were Republicans, namely, Rep. Mountjoy, Ron Paul, President Bush and others. Not ONE Democrat tried to help me or even acknowledged the evidence that I have on my website. Why is that? For the purpose of this Statute, "crime against humanity" means any of the following acts when committed as part of a widespread or systematic attack directed against any civilian population, with knowledge of the attack: (a) Murder; (b) Extermination; (c) Enslavement; (d) Deportation or forcible transfer of population; (e) Imprisonment or other severe deprivation of physical liberty in violation of fundamental rules of international law; (f) Torture; (g) Rape, sexual slavery, enforced prostitution, forced pregnancy, enforced sterilization, or any other form of sexual violence of comparable gravity; (h) Persecution against any identifiable group or collectivity on political, racial, national, ethnic, cultural, religious, gender as defined in paragraph 3, or other grounds that are universally recognized as impermissible under international law, in connection with any act referred to in this paragraph or any crime within the jurisdiction of the Court; (i) Enforced disappearance of persons; (j) The crime of apartheid; (k) Other inhumane acts of a similar character intentionally causing great suffering, or serious injury to body or to mental or physical health. 2. For the purpose of paragraph 1: (a) "Attack directed against any civilian population" means a course of conduct involving the multiple commission of acts referred to in paragraph 1 against any civilian population, pursuant to or in furtherance of a State or organizational policy to commit such attack; (b) "Extermination" includes the intentional infliction of conditions of life, inter alia the deprivation of access to food and medicine, calculated to bring about the destruction of part of a population; (c) "Enslavement" means the exercise of any or all of the powers attaching to the right of ownership over a person and includes the exercise of such power in the course of trafficking in persons, in particular women and children; (d) "Deportation or forcible transfer of population" means forced displacement of the persons concerned by expulsion or other coercive acts from the area in which they are lawfully present, without grounds permitted under international law; (e) "Torture" means the intentional infliction of severe pain or suffering, whether physical or mental, upon a person in the custody or under the control of the accused; except that torture shall not include pain or suffering arising only from, inherent in or incidental to, lawful sanctions; (f) "Forced pregnancy" means the unlawful confinement of a woman forcibly made pregnant, with the intent of affecting the ethnic composition of any population or carrying out other grave violations of international law. This definition shall not in any way be interpreted as affecting national laws relating to pregnancy; (g) "Persecution" means the intentional and severe deprivation of fundamental rights contrary to international law by reason of the identity of the group or collectivity; (h) "The crime of apartheid" means inhumane acts of a character similar to those referred to in paragraph 1, committed in the context of an institutionalized regime of systematic oppression and domination by one racial group over any other racial group or groups and committed with the intention of maintaining that regime; (i) "Enforced disappearance of persons" means the arrest, detention or abduction of persons by, or with the authorization, support or acquiescence of, a State or a political organization, followed by a refusal to acknowledge that deprivation of freedom or to give information on the fate or whereabouts of those persons, with the intention of removing them from the protection of the law for a prolonged period of time. 3. For the purpose of this Statute, it is understood that the term "gender" refers to the two sexes, male and female, within the context of society. The term "gender" does not indicate any meaning different from the above.

I have to tell you what is going on now in Canada so that Americans get hip to the tricks of the homophiles. The other thing going on in the front page news in Canada is that a pregnant mother was murdered and her baby stolen. This has never happened before in British Columbia, but it goes on all the time in California. The plan was to make the parents look incompetent or unstable. If the parents persisted in their efforts to regain custody, especially if they were single or poor, they were made to disappear----they were arrested and or incarcerated and later "taken care of". I was told that accidents could be arranged or hit men hired, but I quit shortly after being hired as I could not do these horrible things to people. Marin county, San Mateo county, and other counties south of San Francisco are leaders in this horrible > industry. Parents disappear and the children are told their parents abandoned them. Use this information as you will. Something must be done to stop these people. These criminals have been selling children since 1977. Why not check out all the parents that have disappeared or died during the time their children go into foster care. Since the Adoption & Safe Families Act, with states in competition for the Federal Funds offered for promoting adoptions, Walter Mondale expressed concerns that states could create a business in dealing with children.

I spoke at the hearing sponsored by Congressman Baca in 2004. Well aparently D.C. has not changed anything. Children are still being stolen for little or no reason at my local CPS office daily. The numbers of murdered children from the foster to adopt program has reached what could be considered epidemic levels. Since I testified my twin sons have spent most of the past couple of years in jail for running away from abusive foster homes and coming home to their family. Pretty sick. They have told the courts they were never abused or neglected until they were put in fostercare. The same old story of being ignored over and over. Well the good thing that will come out of this, is my sons are real rebels. They refuse to stand by and allow this to continue. This week they are petitioning the courts to have all unfounded allegations removed from court record, be placed in my custody and to have the termination orders vacated. We have petitioned the courts regularly reciting the rights they have been denied since the take over started. The courts still say sleeping in alleys and eating out of dumpsters has been in these boys best interest. It is apalling what Government agencies will do to cover Butt when they run into kids like mine. The saga goes on . In the end my children will have suffered at the hands of a corrupt careless entity for absolutly no reason. There are laws against cruel and unusal punishment in crimal courts but not in dependency courts. Why? People are afraid to stand up and fight in fear of losing. I used to be afraid. Now I am damn mad.

After reading these posts I feel I need to make my point. I have not seen any posts commenting on the view of an adult who was molested as a child.

I am such a person. I was molested from ages 6-16 by 5 (FIVE)different family members. I do not call myself a victim... I am a SURVIVOR.

What makes me say that? Simply stated. I would and could only be a "victim" if I would have allowed what happed to me continue to haunt me today and for the rest of my life. I did not allow that. I am a SURVIVOR. I took control of my life. I got the proper treatment and help from professionals as well as very good and close friends who helped me get my life in order. I am now a professional in my community as well as a wife and mother.

My children and my husband are my world and I love them more then life. My sons are now 19 and 16 years old. My oldest son is in college and doing very well. My youngest son is a straight A student in high school as well as captain of his high school football and wrestling teams. My husband is also a professional with his own business.

The important thing I want to say is that my beloved husband is also a registered sex offender. His crime was over 20 years ago and did not involve a child. He is not a repeat offender and he feels great remorse for the crime of which he was convicted.

I have NEVER even had so much as a parking ticket in my whole life yet, because I am the wife of a registered sex offender my life and the way I now have to live it due to the registry restrictions imposed on me makes me feel more like a "victim" then I have ever felt before!

Having my husbands information posted has NOT saved a child. It has harmed CHILDREN. HOW?? Because some parents who were searching the web found my husbands picture and our address. These same parents went to the school and insisted my son no longer be allowed to participate on the sports teams with their children because my husband is a registered sex offender. My son has since been removed from the teams and has lost a majority of his friends.

My oldest son was home alone and our house was broken into and my son was attacked with a knife because the attackers thought he was my husband. (They look very much alike)

My home has been the target of spray paint, bricks into my living room windows just missing us as we sat on the sofa. I have also been told by the county that we have to leave our home because of residency restrictions. I do not live near a school, park or day care. Due to the move, I am going to have to leave my place of employment and my husband will have to relocate his established business. Not to mention my son, will have to start in a new school and pray that ruthless parents don't force his out of the new schools sporting programs.

I am not the only wife or family member of a registered sex offender who is having these as well as many more problems due to the "save the children" laws. I am NOT saying Megan's Law and Jessica's Law are not good tools for public officials however, that is all they are... tools for PUBLIC OFFICIALS. Megan's Law websites should NOT be made public!

For those of you who feel it is your "right to know" who your neighbors are; you can find out all that information by going to your public court house and looking it up. However, when you do research your name and information should also be given so if anything should happen, the same PUBLIC OFFICIALS have some insight as to who was looking this information up.

Reality is, most children of a sexual crime are the "victims" from family members. I am not saying that children are not kidnapped and molested by strangers but, the percentage of those types of crimes are VERY LOW.

What really bothers me is the parents who are not watching their own children. Its time for parents to STOP allowing their children to walk to and from school unattended. They should not allow their child to go play at the playground alone. When you go shopping, don't allow your child to go to the toy section alone while you go do whatever you want to do.
If you can't walk your child to school ask a neighbor or a family member or friend. Have your child buddy up with other kids and walk in a group.

More people protect their pets and cars with micro-chips for fear of theft or loss.People keep their money in the bank for safety reasons. Why would you not take the same prevention with your child?

Using Falsified documents, then if you appeal they change the testimony for appeals court! And that was in regards to the falsified document, (the testimony they changed). After 40 conflicts of interest I quit counting too. If a man or a woman will cheat on their spouce, after making a commitment to God and their guests at the wedding ceremony, they will most likely lie or cheat in the workplace or to others.

As for a politician, ( in either camp ) that's only interest is in getting elected, it's a statistical fact, that most wouldn't know the truth, if the truth smacked them in the face.

Their is no such animal as a reformed liar, when the conscience has been corrupted, from contunual lying among other things.

I have read some of the comments on this incredibly wonderful way to comunicate, I find that my first instinct was one of anger at some level for some entries.

What I do know about child abuse is a life filled with sexual, emotional, mental and physical of abuse in all forms. I have a special interest in Megan's Law and Jessica's Law because my perpetrators will never have to be accountable for what they did. They will never pay for the things that they did to me.

The stance of child abuse is not a Democrat or a Republican or an Independent idea.
Megan's is one that protects families in a way that will help keep our children safe. The only way to keep our children safe, is to enact legislation to help and that is why Megan's List exists.

Jessica's Law is an enactament that will help keep sex offenders in prison longer and help keep the predators out of our children's lives.

While it may be true that most sexual abuse is perpetrated by a known person, it does not mean that it is okay to not prosecute and enact stiff penalities that will keep the perpetrators out of our lives and the lives of the abusers.

I wish so much that the child abuse I exerienced had had someone around to care. It did not. If you actually polled all families of children who have had a perpetrator violate a child's life, you would find that the victim, that precious baby, the beautiful child who has a chance to excell but can't. The children are our future and as such need a promise of hope, a notion of love that has no hidden agenda and a life that is free to be lived without the scarrs that child abuse brings to end the innocence and trust of a child before that child has ever had a chance to be violated.

If the perpetrator was a man attacking and adult female, the cry of out rage would engulf our thoughts and we would all understand the plight of the effects of abuse.

I wrote a narrative essay that is titled, "And the Bidding Began, How Much is the Worth of a Child." If child abuse is not stopped, our children will never have a life that is not shattered.

Have you ever felt the beating of a belt on your back side that leaves the back raw, open sores, and bleeding? Have you ever felt the pain and humiliation of sexual abuse before you are able to talk? Have you ever felt the horrendous burden that comes with yelling and screaming to undercut and crucify the self esteem of a child?

I have and the scars I carry will always be in my life. They never leave. I am disabled because the child abuse I experienced left me legally blind when a tree branch was purposely was grasped and move to hit me. I have Fibromyalgia because of the stress of being a favorite soccer ball, have been used as a drop ball across the room, or made to sit still while the bees cascaded all over my body to teach me to be quiet and not to move. When I think of Megan's Law and Jessica's Law make me feel that my life has a meaning because someone cares enough to come to the rescue and make the perpetrators accountable for their action.

Child abuse is not now, nor will ever be a political issue or a Republican, Democrat or all the other hopeful candidates attempting to run for all kinds of offices.

Jessica's Law and Megan's Law were created with the idea that what happened to Jessica Lunsford and Megan will not be so easy to have happen now. You see, the legacy those two children and their families took tragedies and helped bring about legislation to help combat child abuse of all kinds.

comment but, what I do know is my daughter was molested when she was 6 by my nephew that was 15 and his friend 11 at the time my nephew was sent to a facility to be rehabiliated he came back after 1 year with no restrictions or follow ups and in January 2007 he
molested my daughter again she was 14 and he is 23
and I did report it once I found out he signed a
affidvid admitting it he has not been arrested or anything as of yet I have got run arounds the deputy prosecutor had the nerve to ask me wasn't he related to us? I don't care if he was the Pope I would turn him in and what does that have to do with anything? He also
asked what were we doing to protect her? The deputy prosecutor made us feel belittled and said it was my
daughters fault as much as it was his. I have called
at least 7 times to find out what is going on went to
court house find no charges have been filed go to
prosecutors office and they know nothing then go to Sheriff's Office they can't find file took them about 30-40 minutes to locate it and said orginial investigator no longer works there and he knew nothing
about the case and then I found out today the other
investigator is no longer working their either and
she told my daughters counslor they had enough evidence
to prosecute and the letter I got from Arkansas State
Police said evidence was found to be true and his name
was entered into the Child Maltreatment Registery.
I feel the system has failed us been getting nothing but, run arounds.
