Historic Agreement on Greenhouse Gases: California Legislative Leadership Negotiates Agreement With Governor on What Could Be Model for Country and Other States

At a crowded press conference flanked by environmental leaders from a number of state and national organizations, Speaker of the California Assembly, Fabian Nunez announced that an agreement finally is at hand with the Governor. The bill, AB 32, By Nunez and Assemblymember Fran Pavley, is in print and the Governor has indicated he will sign it.
This was a virtual love fest amongst those who had fought for two years to see AB 32 passed with real enforcement and teeth.
Also speaking was President pro Tem Don Perata, who said that “This was a more significant bill than I thought we could get passed.” He complimented the Speaker and Assemblymember Pavley and a number of staffers who put in countless hours on the bill. He spoke eloquently about being “custodians of the planet” and said that “You’ve got to put your head down when you have science on your side.”
There were questions about what the sticking points were in the negotiations, but Nunez and others declined to answer those questions specifically about what the Governor did not get, preferring instead to extol the bill and the good product he is getting from the legislature.
In attendance were representatives of the National Resources Defense Council, Environmental Defense, the California League of Conservation Voters, the Union of Concerned Scientists, Environment California, Environmental Entrepreneurs, and other prominent environmental groups.
The exact details of the enforcement mechanisms and the differences between the “mandatory” cap and trade mechanism sought by the Governor and the “clear path” to market mechanisms that the Speaker said are in the bill will have to be explained by an expert.
The presence of the environmental groups is a good marker to me that the bill is a good one, puts California which is the twelfth largest emitter of greenhouse gases in the world (larger than most countries) in the role of a model for other states and the nation, and is solid. Indications are that the Democratic leadership negotiated from a position of strength given how important politically this measure is for the Governor.
More environmental legislation is on its way in the waning moments of the current session and indications are that the Governor will be signing other significant measures. Nunez and others indicated California is on its way to becoming a clean fuel state.
A great day for the environment. Everyone will be taking credit.
